This equipment may not conform to Federal Safety Codes nor to the Safety Codes enacted by the various states. Conformance is the responsibility of the Buyer. Buyer agrees to save and hold harmless the Seller from any and all liability connected with the above equipment. Price is F.O.B. our warehouse, Houston, Texas cash with order, unless indicated hereon. Where payment terms are extended, Seller retains a Security Interest in the equipment with the right of repossession without demand until paid in full. All past due balances shall incur an interest charge of 12% compounded monthly until paid in full. All transactions will be deemed made and governed by the laws of the State of Texas, with payment in Houston, Harris County, Texas. It is understood that there are no conditions or agreements outside of this proposal and that all prior conversations, agreements and/or representations with reference to its subject matter are null and void. Any contrary clause contained in the customer purchase order shall not be considered as part of the conditions of sale. All items are sold “As Is”, “Where Is”, and “With All Faults” without exception. Harris Machine Tools, Inc. makes no warranties or guarantees of any kind, expressed or implied, as to the nature, quality, value or condition of the items being sold or their suitability for any use, unless otherwise stated above.
